Terms of Service

These Terms of Service ("Terms") govern access to and use of the Forko restaurant menu platform available at forko.lt and any subdomain or custom domain connected to it (the "Service"), provided by:

("Digirete", "we", "us", or "our"). By creating an account, starting a free trial, or otherwise using the Service, you ("you", the "Customer", or the "restaurant owner") agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What the Service is

Forko lets you create and manage a digital menu for your restaurant, accessible to your customers through a subdomain of forko.lt (e.g. yourrestaurant.forko.lt) or a custom domain you own and connect yourself. The Service includes an administration panel for managing menus, categories, items, images, and related content.

2. Eligibility & account registration

• You must be at least 18 years old and legally able to enter into a binding contract to register.
• You must provide accurate registration information and keep your account details (including your subdomain or custom domain, contact email, and password) up to date.
• You are responsible for all activity that happens under your account, and for keeping your login credentials confidential.
• One account is currently tied to one restaurant. If you need to manage multiple restaurants, contact us — this isn't supported automatically yet.

3. Free trial

New accounts may receive a free trial period, the length of which is shown to you at registration and inside your admin panel. No payment card is required to start a trial. We may change, shorten, extend, or discontinue the free trial offer at any time, including for future registrations, without affecting a trial already in progress.

4. Subscriptions, pricing & billing

• After your trial ends, continued access to a public, live menu requires an active paid subscription.
• Subscriptions are billed in advance, on a recurring basis (e.g. monthly, every 3 months, annually), for the plan and price displayed to you at the time of purchase.
• Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• Payments are processed by Stripe, a third-party payment processor. We do not store your full card details ourselves — see our Privacy Policy for details.
• Prices are shown in euros (€). Digirete, MB is not currently registered for VAT, so no VAT is added to the displayed price.
• You can cancel your subscription at any time from the admin panel. Cancelling stops future renewals — you keep access until the end of the period you've already paid for, then your public menu becomes unavailable to your customers until you resubscribe (your account and content are not deleted).
• Except where required by law, payments already made are non-refundable, including for partial billing periods.
• We may change our prices for future billing periods. If a price change affects an active subscription, we'll give you reasonable notice before it takes effect.

5. Your content & your responsibility for it

• You retain ownership of the content you upload or enter — menu items, descriptions, prices, images, and any other material ("Your Content").
• You are solely responsible for the accuracy of Your Content, including prices, availability, and — importantly — allergen and ingredient information. Forko is a publishing tool; it does not verify, and is not responsible for, the accuracy of any menu content you publish.
• You confirm that you have the right to upload and publish Your Content (e.g. that images and logos are yours to use, or properly licensed), and that it doesn't infringe on anyone else's rights.
• By uploading Your Content, you grant us a limited, non-exclusive license to host, store, and display it as necessary to operate the Service (for example, showing your menu to your customers).
• We may remove content that we reasonably believe violates these Terms or applicable law.

6. Acceptable use

You agree not to use the Service to:

• Publish unlawful, fraudulent, defamatory, or misleading content;
• Infringe the intellectual property, privacy, or other rights of any third party;
• Attempt to gain unauthorized access to another account, restaurant's data, or our infrastructure;
• Interfere with, overload, or disrupt the Service (including circumventing rate limits or bot protection);
• Use the Service for any purpose unrelated to operating a legitimate food or beverage business menu.

7. Service availability & changes

We aim to keep the Service available and reliable, but we do not currently guarantee any specific uptime percentage or service level. The Service may occasionally be unavailable for maintenance, updates, or due to circumstances outside our reasonable control. We may add, change, or remove features over time as the Service evolves.

8. Suspension & termination

• You may stop using the Service and cancel your subscription at any time.
• We may suspend or terminate your account, or take your public menu offline, if: your subscription lapses; you materially breach these Terms; we reasonably suspect fraud, abuse, or illegal activity; or we're required to do so by law.
• Where practical, we'll give you notice before suspending or terminating your account for a policy violation, and a chance to resolve the issue first, except in cases of serious or repeated violations.
• On termination, your right to use the Service ends. We may retain and later delete Your Content in line with our data retention practices described in the Privacy Policy.

9. Disclaimers & limitation of liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available", without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, or consequential damages (such as lost profits or lost business) arising from your use of, or inability to use, the Service.
• Our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the 3 months before the event giving rise to the claim.
• Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence, wilful misconduct, or death or personal injury caused by our negligence).

10. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Service or legal requirements. If we make material changes, we'll make a reasonable effort to notify you (such as by email or a notice in the admin panel) before they take effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

11. Governing law & disputes

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Lithuania. If you are a consumer residing in another EU member state, you may also have the right to bring proceedings in the courts of your own country of residence under applicable EU consumer-protection rules.
